Terms of service

1. Agreement to terms

These Terms of Service ("Terms") govern your use of capscope (the "Service"), operated by Elevate Studio ("capscope", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

capscope provides investor intelligence for founders raising capital: investor profiles built from public sources, fit scoring, screening, a watchlist, and outreach drafting. The Service helps you draft messages; it does not send messages on your behalf. You send your own outreach, from your own email, and are responsible for it.

3. Accounts

• You must provide an accurate email and keep your account secure. Sign-in is by magic link; anyone with access to your email can access your account.
• You are responsible for activity under your account.
• You must be able to form a binding contract to use the Service.

4. Acceptable use

You agree not to:

• Use the Service to send spam, harass, or contact people in violation of applicable law (including anti-spam and data-protection law).
• Scrape, resell, or redistribute the Service's data, or attempt to reconstruct our database.
• Probe, attack, or interfere with the Service's security or infrastructure, or exceed reasonable rate limits.
• Misrepresent yourself or use the Service for any unlawful purpose.

5. Your content & outreach

You retain ownership of the content you submit (your company details, drafts you edit, messages you send). You are solely responsible for the outreach you send and for complying with the laws that apply to it. capscope is a drafting tool; the decision to contact anyone, and the message itself, is yours.

6. Plans, billing & cancellation

• Paid plans are billed in advance through Stripe on the interval you choose (monthly or annual). Prices are shown on the pricing page.
• You can cancel anytime; access continues to the end of the paid period, and plan limits adjust to your current plan.
• Except where required by law, payments are non-refundable. We may change prices with reasonable notice for future billing periods.

7. Intellectual property

The Service, its software, design, and the compiled profiles and analyses (excluding your own content) are owned by capscope and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service while your account is in good standing.

8. Public information & third parties

Investor profiles are built from public sources and provided for your information; they may be incomplete or out of date, and are not investment advice. Links and embeds to third-party sources are provided for reference and are governed by those third parties' terms. Individuals and firms may request correction or removal via the data removal page.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that any profile, score, or draft is accurate, complete, or will produce any particular fundraising outcome.

10. Limitation of liability

To the fullest extent permitted by law, capscope will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or opportunities. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.

11. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms or use the Service in a way that risks harm to others or to the Service.

12. Governing law & changes

These Terms are governed by the laws of Spain, without regard to conflict-of-laws rules. We may update these Terms as the Service evolves; material changes will be posted here with a new effective date, and continued use after changes means you accept them.
